Terms of Service for Maple Leaf Garden Care

1. Introduction and Acceptance of Terms

These Terms of Service (“Terms”) govern the provision of garden and landscape services by Maple Leaf Garden Care (“Maple Leaf Garden Care,” “we,” “us,” or “our”) to customers (“Client,” “you,” or “your”). By requesting, scheduling, accepting, or paying for any services from Maple Leaf Garden Care, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree to these Terms, you must not use or continue to use our services. These Terms apply to all service requests, quotations, work orders, estimates, invoices, and related communications unless otherwise agreed in writing by Maple Leaf Garden Care.

2. Scope of Services

Maple Leaf Garden Care provides residential and commercial garden care and related outdoor maintenance services, which may include:

  • Lawn and garden maintenance
  • Seasonal planting and flower bed design
  • Hedge trimming and pruning
  • Weed control and mulching
  • Spring and fall cleanups
  • Landscape enhancement
  • Irrigation system checks

The exact scope, frequency, timing, and pricing of services will be set out in a quotation, estimate, service agreement, work order, invoice, or other written confirmation issued by Maple Leaf Garden Care. Any services not expressly included may be treated as additional work and billed separately.

We may refuse, suspend, or modify services where site conditions, weather, safety concerns, access restrictions, legal restrictions, or other circumstances make performance impractical or unsafe.

3. User Obligations and Responsibilities

You agree to:

  • Provide accurate, complete, and current information about the property and requested services.
  • Ensure safe and reasonable access to the worksite, including gates, driveways, water access, and utility areas where required.
  • Remove or secure pets, children, vehicles, valuables, fragile items, and hazardous materials before service begins.
  • Disclose known hazards, including underground utilities, irrigation lines, buried cables, unstable structures, pest infestations, or toxic plants.
  • Obtain any required permissions, approvals, permits, or consents from landlords, condominium corporations, municipalities, or other third parties.
  • Maintain the property in a condition suitable for the requested services and promptly notify us of any changes that may affect performance.
  • Review completed work promptly and raise any concerns within a reasonable time after service completion.

You are responsible for damage or delay caused by incomplete information, hidden defects, unsafe conditions, lack of access, or failure to meet your obligations under these Terms.

4. Payment Terms and Conditions

Unless otherwise stated in writing, all fees are due in accordance with the invoice issued by Maple Leaf Garden Care. We may require a deposit, advance payment, or payment milestone for certain services, seasonal projects, or materials.

  • All prices are in Canadian dollars (CAD) unless otherwise specified.
  • Applicable taxes, including GST/HST where required by law, will be added to invoices.
  • Invoices are payable by the due date stated on the invoice or, if no date is stated, within 15 days of issuance.
  • Late payments may result in interest charges at the maximum rate permitted by applicable law, plus reasonable collection costs.
  • We may suspend or refuse future services for overdue accounts.
  • Any estimate provided is based on the information available at the time and may change if site conditions, scope, or material costs change.

If a payment is reversed, disputed without reasonable basis, or returned for insufficient funds, you remain responsible for the full amount due, any bank fees, and any related administrative costs.

5. Cancellation and Refund Policy

You may cancel or reschedule a service by providing reasonable notice. For recurring or scheduled services, at least 24 hours’ notice is preferred unless a different notice period is stated in your service agreement or invoice.

  • Late cancellations may be subject to a cancellation fee to cover scheduling and labour costs.
  • Custom orders, special materials, plants, mulch, or third-party purchases may be non-refundable once ordered or delivered.
  • Refunds, if any, are issued at our discretion where services were not performed as agreed or where a refund is required by law.
  • Weather-related postponements are not cancellations and may be rescheduled at the earliest reasonable opportunity.

If you believe a service was not performed in accordance with the agreed scope, you must notify Maple Leaf Garden Care within 7 days of completion so we may investigate and, where appropriate, correct the issue.

6. Liability Limitations

To the fullest extent permitted by applicable Canadian law, Maple Leaf Garden Care shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of enjoyment, or business interruption, arising from or related to our services.

Our total liability for any claim arising out of or relating to the services, whether in contract, tort, negligence, or otherwise, shall not exceed the amount paid by you to Maple Leaf Garden Care for the specific service giving rise to the claim, except where such limitation is prohibited by law.

We are not responsible for pre-existing damage, hidden defects, underground utilities, irrigation systems, drainage issues, structural problems, pest damage, or conditions beyond our reasonable control. We are also not liable for damage caused by acts or omissions of the Client, third parties, weather events, wildlife, or force majeure events.

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for gross negligence, wilful misconduct, or any non-excludable consumer rights under applicable Canadian law.

7. Intellectual Property Rights

All content created or provided by Maple Leaf Garden Care, including service descriptions, written materials, designs, plans, photographs, estimates, and branded materials, remains our property or the property of our licensors unless otherwise agreed in writing.

Subject to full payment, you receive a limited, non-exclusive, non-transferable licence to use any deliverables provided solely for the purpose of receiving and maintaining the services at your property.

You may not copy, reproduce, distribute, modify, publish, or commercially exploit our materials without prior written consent, except as permitted by law. We may use photographs of completed work for portfolio, marketing, or record-keeping purposes, provided that we do not knowingly disclose personal information without consent where required by law.

8. Data Protection and Privacy

Maple Leaf Garden Care collects, uses, stores, and discloses personal information only as necessary to provide services, manage accounts, communicate with clients, process payments, maintain records, and comply with legal obligations.

We handle personal information in accordance with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and any applicable provincial privacy legislation.

  • We take reasonable administrative, technical, and physical safeguards to protect personal information.
  • We may share information with service providers, payment processors, insurers, or legal authorities where necessary and lawful.
  • You may request access to or correction of your personal information, subject to legal limitations.
  • We may retain records for as long as reasonably necessary for business, tax, insurance, or legal purposes.

By using our services, you consent to the collection, use, and disclosure of your personal information as described in these Terms and in any applicable privacy notice we provide.

9. Force Majeure

Maple Leaf Garden Care shall not be liable for any delay or failure to perform caused by events beyond our reasonable control, including but not limited to severe weather, storms, flooding, fire, labour disputes, supply shortages, power outages, government actions, public health emergencies, transportation disruptions, or acts of God.

In such circumstances, we may suspend, delay, or reschedule services without liability. We will make reasonable efforts to notify you and resume services as soon as practicable.

10. Changes to Terms

Maple Leaf Garden Care may update or revise these Terms from time to time to reflect changes in our business practices, legal requirements, or service offerings. The updated Terms will be effective on the date indicated at the top of the document or on another date we specify.

Continued use of our services after any changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using our services.

11. Applicable Law and Jurisdiction

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

You agree that any dispute arising out of or relating to these Terms or our services shall be brought exclusively in the courts located in Toronto, Ontario, unless applicable law requires otherwise.

13. Severability Clause

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed or limited to the minimum extent necessary so that the remaining provisions continue in full force and effect.

The failure of Maple Leaf Garden Care to enforce any right or provision under these Terms shall not constitute a waiver of that right or provision unless expressly stated in writing.

By engaging Maple Leaf Garden Care, you acknowledge that you have read, understood, and agree to these Terms of Service.
